END-USER LICENSE AGREEMENT - DUAL LICENSE

This agreement applies to all products and services of avnxsim.com, hereafter named AVNX. The terms applying to you are depending on whether the product is provided to you as freeware or payware. Please read the sections that are applicable to you.

PART I: GENERAL TERMS (APPLICABLE TO ALL AVNX PRODUCTS OR SERVICES)

1. Grant of License.
Subject to the terms and conditions of this EULA, AVNX grants you, hereafter named “the Licensee”, a non-exclusive, non-transferable, and revocable license to install and use the Products on one or more computers and/or devices for personal, non-commercial use.

2. Intellectual Property and Ownership Rights.
The Products, including all source code, graphics, and media, are the intellectual property of AVNX and are protected by copyright and other intellectual property laws. All rights not expressly granted to you are reserved by AVNX. This license grants you a limited right to use the Products and does not transfer any ownership rights. All copyright and license notices must be retained and not altered or removed.

3. Restrictions.
- You may not reverse engineer, decompile, or disassemble the Products, except where such a restriction is expressly prohibited by law for interoperability purposes. Reverse engineering for the purpose of circumventing license protection or developing competing products is strictly prohibited.- You may not distribute, sell, lease, sublicense, or otherwise transfer the Products, or any part thereof, to any third party, unless explicitly permitted in this EULA.

4. Quality and Branding.
You may not use the AVNX name, logo, or any other trademarks to brand, distribute, or otherwise promote any products, including modified versions, that are not original and official products of AVNX. The distribution of any modified versions is expressly prohibited to protect the reputation and quality standards of the AVNX brand.

5. Source Code & Graphics.
Source code is provided in an unencrypted form for personal use only. Viewing and modification are permitted only within the limits of the license terms below. Graphics and media are unprotected; however, their use is restricted to the purposes outlined in this EULA.

6. Disclaimer of Warranty.
THE PRODUCTS ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND. AVNX HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AVNX DOES NOT WARRANT THAT THE PRODUCTS WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF BUGS OR VIRUSES.

7. Limitation of Liability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AVNX BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS), ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCTS, EVEN IF AVNX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Termination.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from AVNX if you fail to comply with any of its terms. Upon termination, you must cease all use of the Products and destroy all copies in your possession.

9. Governing Law.
This agreement shall be governed by the laws of Belgium, without regard to its conflict of law principles. Any legal action or proceeding relating to this EULA shall be brought exclusively in the courts located in Belgium.

10. Entire Agreement.
This EULA constitutes the entire agreement between you and AVNX concerning the Products and supersedes all prior or contemporaneous understandings, agreements, or communications, whether written or oral.

11. Streaming and Content Creation.
Notwithstanding the provisions in Part II, Section 4 and Part III, Section 3, the Licensee is hereby granted permission to use and display the Products in publicly available content, including but not limited to live streams, videos, and other digital media. You are permitted to monetize this content through advertising, subscriptions, donations, or other similar methods. We kindly request that you provide a visible and clear attribution to AVNX in such content, where possible. This permission is granted solely for content creation and does not constitute a broader commercial license for other purposes.

12. Amendments to the EULA.
AVNX reserves the right to modify, amend, or update this EULA at any time without prior notice. The updated EULA will be effective immediately upon publication on the AVNX website. Your continued use of the Products constitutes your binding acceptance of the revised EULA.

PART II: ADDITIONAL TERMS FOR PAYWARE PRODUCTS (PROPRIETARY LICENSE)

1. License Grant.
Upon payment of the specified fee, AVNX grants you a non-exclusive, non-transferable, proprietary single-user license to use the payware Products. This license is valid for the lifetime of the product unless otherwise terminated as per Section 7 of Part I.

2. Distribution & Modification.
Distribution of the Products, or any modified versions, is not allowed without prior written permission from AVNX. Modifications are permitted for private personal use only; modified versions may not be published or distributed to any third party.

3. Commercial Use.
Commercial use of payware Products is not permitted unless explicitly agreed upon in a separate written contract.

4. Refunds.
All sales of payware Products are final. AVNX does not offer refunds.
